These Terms of Service ("Terms") govern your access to and use of the WishList website and service at mywishlist.gifts (the "Service"). The Service is operated by Aerial Aspect Media, LLC ("we," "us," or "our"), located at 8401 Mayland Dr., Ste A, Richmond, VA 23294.
By creating an account, checking the box indicating that you agree to these Terms, or otherwise accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
WishList is a free online tool that lets you create and manage gift wishlists, add items (including links to products on third-party retail websites), organize items into multiple lists, optionally share lists publicly through a unique link, connect with friends, mark items as purchased, and keep private notes. We may add, change, or remove features at any time.
The Service is provided to you free of charge. We do not currently charge a fee to create an account or use the Service.
You must be at least 13 years old to use the Service. If you are under the age of majority in your place of residence (typically 18), you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these requirements and that all registration information you provide is accurate.
The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us so we can remove it.
To use most features you must create an account with a username, email address, and password. You agree to:
We are not liable for any loss arising from unauthorized use of your account. We may suspend or terminate accounts as described in Section 11.
"Your Content" means anything you submit to the Service, including wishlist names, item descriptions, product links, notes, profile information (such as a display name, birthday, clothing sizes, and an optional profile picture), and feedback.
We may remove any content that we believe violates these Terms or may expose us or others to liability, but we have no obligation to monitor content.
You may choose to make a wishlist public. When you do, anyone who has the share link can view that list and the items on it without logging in, and they may indicate that they have purchased an item. Share links are unguessable but are not otherwise access-controlled — treat a public list as visible to anyone you give the link to, and anyone they pass it to. Do not include sensitive personal information in items, notes, or list names that you make public.

The Service lets you save links to products sold by third-party retailers. We do not sell any products. We are not a party to, and are not responsible for, any transaction between you (or anyone viewing your list) and a third-party retailer, including product availability, pricing, quality, payment, shipping, returns, or any dispute.
Any price you enter for an item is information you provide; it is not maintained, verified, or updated by us and may not reflect the retailer's current price.
Affiliate disclosure. Aerial Aspect Media, LLC participates in the Amazon Services LLC Associates Program and may participate in other affiliate programs. This means some product links on the Service may be modified to include an affiliate tag, and we may earn a commission when you or others click a link and make a qualifying purchase, at no extra cost to you. This does not change the price you pay.
Third-party websites have their own terms and privacy practices, which we do not control and are not responsible for.
By creating an account, you agree that we may send you transactional emails necessary to operate the Service — for example, password-reset emails, security and login alerts, and friend invitations. These are not promotional and you cannot opt out of them while you maintain an account.
You may separately opt in to receive occasional announcement emails. You can unsubscribe from those at any time using the link in the email or through your profile settings.
Your use of the Service is also governed by our Privacy Policy, which explains what information we collect (including account details, profile information, IP address and approximate location captured at login, and usage data) and how we use it. By using the Service you consent to the practices described in that policy.
The Service itself — including its software, design, logos, and the "WishList" name and branding — is owned by Aerial Aspect Media, LLC and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or other brand features without our prior written permission. We grant you a limited, personal, non-transferable, revocable license to use the Service in accordance with these Terms.
You may stop using the Service and request deletion of your account at any time by contacting us at [email protected].
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, if required by law, or to protect the Service or other users. Upon termination, your right to use the Service ends. Sections that by their nature should survive termination (including Sections 4, 7, 10, 12, 13, and 14) will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY DATA WILL BE PRESERVED OR ALWAYS AVAILABLE. YOU USE THE SERVICE AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AERIAL ASPECT MEDIA, LLC AND ITS OWNERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN OF THESE LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
You agree to indemnify and hold harmless Aerial Aspect Media, LLC and its owners, officers, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, Your Content, or your violation of these Terms or any law or third-party right.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and may provide additional notice (such as an in-app notice or email). Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Virginia, and you consent to the personal jurisdiction of those courts.
